In this paper I present a sorting and accounting of a variety of things which fall or might fall under the rubric "saying something." The object is clarification--the illumination of an area which can be a source of much confusion in discussion and analysis of speech acts. The point of departure is Austin's initial analysis of saying, in which he tries to set out the "acts" or "doings" which are supposed to be in some sense the elements of the (...) total act of saying. From this, I develop an analysis of saying which may be seen either as an improved version of Austin's or as an alternative analysis, depending on one's assessment of the significance of its departure from Austin's initial intent or insight. I am inclined to see it as an alternative, though hardly a radical one. (shrink)

Nietzsche has the reputation of being a virulent misogynist, so why are feminists interested in his philosophy? The essays in this volume provide answers to this question from a variety of feminist perspectives. The organization of the volume into two sets of essays, "Nietzsche's Use of Woman" and "Feminists' Use of Nietzsche," reflects the two general approaches taken to the issue of Nietzsche and woman. First, many debates have focused on how to interpret Nietzsche's remarks about women and femininity. Are (...) all of Nietzsche's comments to be read literally, or is he being ironic, perhaps even parodying and subverting stereotypes about women? Second, is his philosophy useful to feminist theory? Can we separate his philosophy from his seemingly derogatory remarks about women? Can feminists use his criticisms of truth, objectivity, reason, and the autonomous subject to challenge the exclusion of women from the history of philosophy? Some view his critiques of dualism and essentialism as well as his perspectivism and social constructivism as adumbrating later feminist positions. Others find troubling his privileging of masculinity and paradigms of domination; they see Nietzsche's sexual dualism as countering otherwise transgressive themes. In lieu of an abstract, here is a brief excerpt of the content:Feminist Studies 41, no. 3. © 2015 by Kathryn Kein 671 Kathryn Kein Recovering Our Sense of Humor: New Directions in Feminist Humor Studies At the 2014 annual meeting of the American Studies Association (ASA), the Humor Studies Caucus held a panel titled “Female Comedians and the Critical Power of Laughter.” After listening to presentations on Gilda Radner, Lily Tomlin, and Black women comedians’ 1960s comedy albums, one audience (...) member asked the panel if the classic theories of humor—Freud’s theory of the joke, Bergson’s thoughts on laughter (all conceived of in relation to the work of men)—applied when analyzing female comedic performers. One panelist immediately responded that she found none of those theories useful to her work on female comedians, and that instead she used queer theory to aid her analysis. This exchange at ASA points to many of the questions that scholars of humor and feminism are currently facing as they work to address a dearth of scholarship dealing with women, feminism, and comedy. The nods in agreement around the room spoke to the notion that scholarship on the topic of women in comedy is not merely filling in gaps, but breaking new ground. With a few notable exceptions, scholars have been relatively silent on topics involving women and/in comedy.1 The meager 1. Former Saturday Night Live writer Anne Beatts recalled that star John Belushi, being of the “chicks-aren’t-funny” school, often requested that the women writers be fired.2 In her bestselling Bossypants, Tina Fey recalls that the gender imbalance of the sketch comedy teams at Chicago’s Second City were due to the fact that directors believed “the audience doesn’t want to see a scene between two women.”3 In his 2007 piece in Vanity Fair brashly titled “Why Women Aren’t Funny,” Christopher Hitchens went so far as to call women and humor “antithetical.”4 In particular, feminist women have been painted as humorless and unable to take a joke. Anthropologists have provided rich field descriptions of the norms and conventions governing behavior and interactions in small-scale societies. Here, we add a further dimension to this work by presenting hypothetical moral dilemmas involving harm, to a small-scale, agrarian Mayan population, with the specific goal of exploring the hypothesis that certain moral principles apply universally. We presented Mayan participants with moral dilemmas translated into their native language, Tseltal. Paralleling several studies carried out with educated subjects living in large-scale, developed nations, the (...) Mayan participants judged harms caused as the means to a greater good as more forbidden than harms caused as a side-effect (i.e., side-effect bias). However, unlike these other populations living in large-scale societies, as well as a more educated and less rural Mayan comparison group, the target rural Mayan participants did not judge actions causing harm as worse than omissions (i.e., omission bias). A series of probes targeting the action-omission distinction suggest that the absence of an omission bias among the rural Mayan participants was not due to difficulties comprehending the dilemmas, using the judgment scale, or in attributing a greater causal role for actions over omissions. Thus, while the moral distinction between means and side-effect may be more universal, the moral distinction between actions and omission appears to be open to greater cross-cultural variation. We discuss these results in light of issues concerning the role of biological constraints and cultural variation in moral decision-making, as well as the limitations of such experimental, cross-cultural research. Women have historically been prevented from living autonomously by systematic injustice, subordination, and oppression. The lingering effects of these practices have prompted many feminists to view autonomy with suspicion. Here, Marilyn Friedman defends the ideal of feminist autonomy. In her eyes, behavior is autonomous if it accords with the wants, cares, values, or commitments that the actor has reaffirmed and is able to sustain in the face of opposition. By her account, autonomy is socially grounded yet also individualizing and (...) sometimes socially disruptive, qualities that can be ultimately advantageous for women. Friedman applies the concept of autonomy to domains of special interest to women. She defends the importance of autonomy in romantic love, considers how social institutions should respond to women who choose to remain in abusive relationships, and argues that liberal societies should tolerate minority cultural practices that violate women's rights so long as the women in question have chosen autonomously to live according to those practices. The distinction between a type and its tokens is a useful metaphysical distinction. In §1 it is explained what it is, and what it is not. Its importance and wide applicability in linguistics, philosophy, science and everyday life are briefly surveyed in §2. Whether types are universals is discussed in §3. §4 discusses some other suggestions for what types are, both generally and specifically. Is a type the sets of its tokens? What exactly is a word, a symphony, a species? (...) §5 asks what a token is. §6 considers the relation between types and their tokens. Do the type and all its tokens share the same properties? Must all the tokens be alike in some or all respects? §7 explains some problems for the view that types exist, and some problems for the view that they don't. §8 elucidates a distinction often confused with the type-token distinction, that between a type (or token) and an occurrence of it. This paper explores the implications of conceptualising phenomenology as explanatory for the ongoing dialogue between the phenomenological tradition and cognitive science, especially enactive approaches to cognition. The first half of the paper offers three interlinked arguments: Firstly, that differentiating between phenomenology and the natural sciences by designating one as descriptive and the other as explanatory undermines opportunities for the kind of productive friction that is required for genuine ‘mutual enlightenment’. Secondly, that conceiving of phenomenology as descriptive rather than explanatory risks (...) committing us to what Zahavi (2019) identifies as the error of equating the phenomenological with the phenomenal. Finally, that the erroneous reduction to the descriptive occludes the rich resources that the phenomenological tradition can contribute to investigations of non-human cognition. The second half of the paper then turns to focus specifically on the promising relationship between phenomenology and enactive approaches to cognition. It will suggest that phenomenology must be seen as having explanatory capacities if it is to shed light on the structures of “mind in life” (Thompson, 2007), before drawing on the model of explanation put forward by Louis Sass to explore what this might look like. While pharmaceutical industry involvement in producing, interpreting, and regulating medical knowledge and practice is widely accepted and believed to promote medical innovation, industry-favouring biases may result in prioritizing corporate profit above public health. Using diabetes as our example, we review successive changes over forty years in screening, diagnosis, and treatment guidelines for type 2 diabetes and prediabetes, which have dramatically expanded the population prescribed diabetes drugs, generating a billion-dollar market. We argue that these guideline recommendations have emerged under pervasive industry (...) influence and persisted, despite weak evidence for their health benefits and indications of serious adverse effects associated with many of the drugs they recommend. We consider pharmaceutical industry conflicts of interest in some of the research and publications supporting these revisions, and in related standard-setting committees and oversight panels. We raise concern over the long-term impact of these multifaceted involvements. Rather than accept industry conflicts of interest as normal, needing only to be monitored and managed, we suggest challenging that normalcy, and ask: what are the real costs of tolerating such industry participation? We urge the development of a broader focus to fully understand and curtail the systemic nature of industry’s influence over medical knowledge and practice. (shrink)

In this paper, the theory of syllogistic reasoning proposed by Johnson-Laird is shown to be inadequate and an alternative theory is put forward. Protocols of people attempting to solve syllogistic problems and explaining to another person how they reached their conclusions were obtained. Two main groups of subjects were identified. One group represented the relationship between classes in a spatial manner that was supplemented by a verbal representation. The other group used a primarily verbal representation. While models of business ethics increasingly recognize that ethical behavior varies cross-culturally, scant attention has been given to understanding how culture affects the ethical reasoning process that predicates individuals' ethical actions. To address this gap, this paper illustrates how culture may affect the various components of individuals' ethical reasoning by integrating findings from the cross-cultural management literature with cognitive-developmental perspective. Implications for future research and transnational organizations are discussed.

This essay presents a moral argument for the rationality of theistic belief. If all I have to go on morally are my own moral intuitions and reasoning and those of others, I am rationally led to skepticism, both about the possibility of moral knowledge and about my moral effectiveness. This skepticism is extensive, amounting to moral despair. But such despair cannot be rational. It follows that the assumption of the argument must be false and I must be able to rely (...) on more than my own human powers and those of others in attempting to live a moral life. Over the last several decades legal scholars have plumbed law's rhetorical life. Scholars have done so under various rubrics, with law and literature being among the most fruitful venues for the exploration of law's rhetoric and the way rhetoric shapes law. Today, new approaches are shaping this exploration. Among the most important of these approaches is the turn toward history and toward what might be called an 'embedded' analysis of rhetoric in law. Historical and embedded approaches locate that analysis in (...) particular contexts, seeking to draw our attention to how the rhetorical dimensions of legal life works in those contexts. The meaning of dignity in health care has been primarily explored using interviews and surveys with various patient groups, as well as with health care practitioners. Philosophical analysis of dignity is largely avoided, as the existing philosophical literature is complex, multifaceted and of unclear relevance to health care settings. The aim of this paper is to develop a straightforward philosophical concept of dignity which is then applied to existing qualitative research. In health care settings, a patient has dignity when he (...) or she is able to live in accordance with his or her standards and values. Accordingly, health care practitioners respect a patient's dignity when they refrain from transgressing the patient's standards and values, or refrain from forcing the patient to transgress his or her standards and values. This concept is shown to explain and illuminate most of the key qualitative findings. It therefore provides a more coherent and synthesised concept of dignity in health care. (shrink)

This paper reviews Kohlberg''s (1969) theory of cognitive moral development, highlighting moral reasoning research relevant to the business ethics domain. Implications for future business ethics research, higher education and training, and the management of ethical/unethical behavior are discussed.

In the lead article, Vardoulakis argues that Heidegger elides and occludes animportant difference between two senses of what it means for something to becalculable. On the one hand, there is‘that which can be calculated with somecertainty’, which Vardoulakis dubs the‘calculated’. On the other, there is‘calculating’, the process of proceeding‘even though we know that such acalculation can never be certain or secure as it lacks a determinate measurement’.Iwant to suggest, however, that such a distinction does play a significant role inHeidegger’s work, (...) albeit in an unexpected place: his analyses of time. I will traceout what I consider to be two likely manifestations of the different senses of thecalculable. Turningfirst toBeing and Time, I will propose that we can read therelationship between world-time and now-time through this lens. For Heidegger,the pernicious factor that gives rise to the ordinary conception of time is not time’scalculability as such, but rather the dominance of what Vardoulakis calls thecalculated. Secondly, I want to draw out the role that the dynamic betweencalculating and calculated can be seen to play in Heidegger’s analyses of theAnaximander fragment, especially the way he distinguishes time’s‘allocationcharacter’(Zuweisungscharakter) from mere‘numerability’. London: Verso, 1996.Judging from the recent spate of publications devoted to the question of the universal, it appears that, in the view of some critics, we are witnessing a reevaluation of its dismantling in twentieth-century thought. One of the many oddities about this “return of the universal” 1 is the idea that contemporary engagements with it are (...) more or less of a piece, and that they reflect a growing consensus that poststructuralist political theories are incapable of generating a viable alternative to the collective fragmentation that characterizes late modernity. 2 The putative return to the universal marks, on this view, both a homecoming to Enlightenment ideals—purified of their more poisonous elements, of course—and a reconciliation of sorts between those who refuted these ideals and those who sought to realize them. Now that “we” all know and agree that poststructuralism is critically valuable but politically bankrupt; now that we all know and agree that the “old universal” was indeed a “pseudo-universal,” so the homecoming narrative goes; we can get on with the project of constructing a “new universal.” 3 This authentic universal would really be inclusive of all people, regardless of race, class, gender, sexuality, ethnicity, nationality, and whatever else attaches to the “embarrassing etcetera” that, as Judith [End Page 3] Butler reminds us, inevitably accompanies such gestures of acknowledging human diversity.Before signing on to this felicitous agreement about “the necessity of universalism,” we may wish to know whether we have anything like a minimal agreement in language, that is, whether we who speak of this universal are even speaking about the same thing. Apart from the not insignificant problem of translating from a philosophical to a political idiom, the whole question of this agreement is virtually occluded by the rush to rescue politics from the virulent particularisms that admit no common ground or sense of collective belonging. Presented in terms of the familiar binary couple, the choice between universalism and particularism seems settled by merely pointing to global and domestic political realities. Universalism is the only alternative to social fragmentation, wild child of the collapse of communism, the rise of deadly nationalisms, and the multiculturalist romance with particularism. To invoke the name of the universal in any affirmative sense is already to sign on to the political diagnosis and its solution.One of the many virtues of Ernesto Laclau’s Emancipation(s) is that it offers both an alternative to the binarisms spawned by the “return” to the universal (for example, false universalism/true universalism) and a trenchant critique of the original binary couple itself (universalism/ particularism). Demonstrating the imbrication of the universal and the particular, Laclau shows why it is a matter not of choosing one over the other but of articulating, in a scrupulously political sense, the relation between the two. He thus explicitly rejects the notion that this relation is one of mutual exclusion, and shows that the tendency to see it as just that has led to the impasse of the contemporary debate, an impasse that is glossed over in some highly visible academic cases by proclaiming the necessary return to the universal. Although the language of universalism as spoken by Laclau searches for some common ground between particularists and universalists, it is more by way of articulating their mutual contamination, that is, how each is rendered impure by the irreducible presence of the other.The Problem of UniversalsLaclau situates his collection of essays in the context of the increasingly polarized debate over multiculturalism, a debate in which the classical universalism of the philosophical tradition has come under serious question.
